Pursuant to Article 13 (1) and (2) of the General Data Protection Regulation of 27 April 2016 (hereinafter referred to as “GDPR”), we wish to inform you that:

If you use Water Park’s services through other Entities – Partners of the Water Park (hereinafter referred to as the “Intermediaries”), such Entities will also process your personal data to the extent they have been made available by you. The detailed principles for processing personal data by the Intermediaries are defined in their procedures and privacy policies, hence, we encourage you to read them.

  1. Purposes of personal data processing legal basis and obligation to provide personal data:

The Water Park shall process your personal data to a necessary extent, in order to fulfil obligations and exercise rights under the agreements made,
3.1. under Article 6 (1) (b) of the GDPR, with a view to:

  • providing recreational and sporting services,
  • performing catering services,
  • holding special events,
  • making available of conference, training and sports premises,
  • letting premises.

Providing personal data is voluntary, but necessary to conclude and perform the agreement.
3.2. The Water Park may process your personal data to the extent necessary by virtue of Article 6 sec. 1 (c) or (f) GDPR, to fulfil a legal obligation of the Water Park or exercise legitimate interests of the Water Park, for the purpose of:

  • ensuring the security of persons and property, i.a. by means of video surveillance of all public areas inside the facility and in its immediate surroundings;
  • handling possible complaints, determining or seeking claims or defending against claims;
  • dealing with lost and found articles within the area of the Water Park.

3.3. The Water Park may process your personal data pursuant to Article 6 sec. 1 (c) or (d) GDPR to fulfil the legal obligation of the Water Park or to protect vested interests of data subjects. If necessary, in case of events that take place within the area of the Water Park, in particular if it is required to provide first aid.
Providing personal data for the stated purpose is essential to allow the Water Park take appropriate actions.
3.4. The Water Park may process your personal data to the extent necessary, pursuant
to Article 6 sec. 1 (a) GDPR , upon your voluntary consent, for the following purposes:

  • registration of a member of Fit Park Club,
  • marketing and/or informational purposes or choice of an appropriate package
    of promotional and other services.

Provision of personal data as part of the consent given is voluntary and the consent may be withdrawn at any time. The manner of withdrawing consent and consequences of failing to give
or to withdraw such consent are determined each time by the Controller in the information provided while obtaining the said consent).

  1. Information on the categories of personal data recipients:

Your personal data may be disclosed solely to:

  • the employees and associates of the Water Park who have authorisation to process personal data in connection with the performance of business duties,
  • the entities liaising in using the services the Water Park at your request,
  • the technical and organisational services providers for the Water Park to the extent necessary to perform thereof, but solely within the scope of authorisations or entrustments
    (in particular, to providers and entities specialised for ensuring the technical service of ICT systems and video surveillance systems),
  • the entities which are authorised under the provisions of law.
  1. Transfer of personal data to a third country or international organisation:

The Water Park shall not transfer your personal data to recipients located outside the European Economic Area (the member states of the European Union, Iceland, Norway and Liechtenstein);

  1. Period for which personal data shall be stored:

The Water Park shall process your personal data for the period necessary to perform the services requested by you in accordance with an agreement and shall store your personal data for the period as required by provisions of law for the purposes of archiving, fulfilling the requirements under applicable provisions for accounting and keeping tax records, and possibly of settling mutual claims.
The data processed within the video surveillance of the swimming hall as well as such surveillance of other public areas shall be automatically overwritten and stored for the period of seven days, after which shall be replaced with current data, subject to situations in which it is necessary to conduct explanatory proceedings due to the breaches of the security of persons and property. For such special situations, the processing of the data from the video surveillance shall be effected according to existing circumstances and legal requirements.

  1. Rights of the person whose data are processed:

You have the right of access to the content of your data and the right to have the inaccurate data rectified and incomplete data completed, and to erasure of data – upon the lapse of the storage period provided for in applicable provisions of law, as well as the right to restriction of processing and data portability, as to the data provided to the Water Park.
If your personal data are processed pursuant to the consent given, you are entitled to withdraw such consent at any time. On the other hand, if your personal data are processed in compliance with a legitimate interest of the Controller of Personal Data, you are entitled to object to such processing due to your specific situation.
You have the right to lodge a complaint with a supervisory authority.

  1. Information on automated decision-making:

You shall not be subject to decisions made by automated means (without human involvement). Your personal data shall also not be used for profiling without prior consent for this.
The scope of profiling may be performed by the Personal Data Controller and joint processors within the scope of liaison services in relation to your personal data with separately expressed consent for this purpose, e.g. concerning an adequate package of services for you or a loyalty package (a detailed information duty of the Water Park shall be carried out upon obtaining voluntary consent).
The Water Park may profile your personal data on the basis of separate consent given for that purpose, e.g. to determine the appropriate package of services for your or loyalty package (the detailed information obligation of the Water Park shall be satisfied on the basis of voluntary consent).
The Intermediaries and communication channels may implement the scope of profiling with respect to your personal data according to your own choice and decision on how such personal data should be used. The Water Park recommends each time reading the procedures and privacy policies of the aforesaid Intermediaries or service providers.
